I think everyone needs to look at compliance to internal policy as well as compliance to FTC and OCR.  These are big tasks not to be taken too lightly.  Internet, privacy and security

Excerpt: A big take away for me were the similarities of the Federal Trade Commission’s investigations and the Office of Civil Rights Privacy post-breach investigations. Both agencies investigations are evaluating organizational policies and procedures, determining if they are current and if they are being followed consistently. The number of investigations completed by the FTC is much greater than OCR. I found this interesting because we are now beginning to see the Office of Civil Rights ramp up their investigation program and levy fines against organizations that are found out of compliance. If, the OCR follows the FTC’s lead related to privacy breaches it is about to get more expensive to be a healthcare organization, unless your business is compliant with HIPAA and HITECH regulations prior to a data breach.

FTC is updating its policies and YOU / WE need to know the outcome in order to stay in compliance.  Now that everyone is on the Internet with websites and blogs, the rules of what and how published, endorsed or not, advertised or not, testimonial or not are needs-to-know for all.  Small business need-to-know and news-to-watch

Excerpt: If you’re doing content marketing and reaching out to bloggers and other social-media “influencers,” get ready for more disclosure rules now in the offing.

The Word of Mouth Marketing Association is seeking comment on its updated Social Media Marketing Disclosure Guide before forwarding a final version to the Federal Trade Commission. The guide is meant to help businesses and bloggers comply with the FTC’s Guides Concerning the Use of Endorsements and Testimonials in Advertising.

The update, still in draft form, suggests marketers establish an in-house media policy so everyone — advocates, agencies, partners, networks and vendors — knows what the required disclosures entail in order to prevent false or misleading claims.

What’s more, bloggers and other influencers — would need to make sure their relationship with a marketer is publicly disclosed when making statements, reviews or endorsements about that marketer’s product or service.

The proposed policy also recommends prominent placement of disclosures where consumers can readily access the content — not buried deep in the content in a tiny point size — and must be clearly stated.

F.T.C. Seeks Privacy Legislation – NYTimes.com

Excerpt……The agency, the Federal Trade Commission, called on Congress to enact legislation regulating so-called data brokers, which compile and trade a wide range of personal and financial data about millions of consumers from online and offline sources. The legislation would give consumers access to information collected about them and allow them to correct and update such data.

Excerpt……One last thought is that folks will be quick to point out that the FTC decided not to take further action in this case. The lesson here is that just because they did not take further action in this case, does not mean that you should not take action. Make sure your social media policies are up to date, clearly communicated, shared with your agencies and that you are effectively monitoring for compliance with your policies.
